Parent/caregivers are to accept full responsibility for the safety and supervision of your child/children whilst attending a Sunny Kids club session. Please do not leave your child unattended at any time.

Sunny Kids Club and Dunsborough Community Farm take no responsibility for any injuries sustained during a session. There will be a fully stocked first aid kit on site.

All products used are non-toxic or taste-safe however they are not intended to be eaten. There will be no nuts, soy, dairy or eggs in our messy play but some products used will have allergy labels (mainly oats containing gluten). Please advise us of any allergies your child has at the time of booking.

Sunny Kids Club and Dunsborough Community Farm take no responsibility for loss, theft or damage of personal belongings during a session.

Some of the sessions can involve messy play so please dress your child in clothes that you do not mind getting stained or dirty. Sunny Kids Club takes no responsibility for clothes damaged or stained during sessions

Cancellation Policy:

Sunny Kids Club takes no responsibility if you fail to attend a session for any reason (including sickness) due to costs and materials already brought to run sessions. No credits or refunds will be given.

Please do not attend a session if you or your child is showing signs of sickness, We reserve the right to ask you to leave if you or your child display signs of sickness to be contagious to others.

Sunny Kids Club reserves the right to cancel a session due to unforeseen circumstances. In this case, a make-up session will be held and if this is not possible either a credit will be given to the families to use for a future session or a refund will be given.

Photos and videos will be taken during the sessions for promotional use only. For website, social media and advertising purposes. If you do not wish to have photos taken of yourself or your child during the session please state that on your booking form and let the event supervisor know on your arrival. Permission will always be asked before taking photos at a session. Please also be mindful when taking your own photos of your children. Do not take photos of anyone without permission.

WAIVER:

This Waiver applies to children’s play services provided by Sunny Kids Club, ABN 81 579 145 928.

When you agree to this Waiver, you do so on your behalf and that of your child or your children who are participating in Sunny Kids Club programs and events.

Play services include but are not limited to child-led sensory play, messy play, risky play, loose parts play, nature play and bush walking. Activities include access to water, small and large loose parts and children’s tools.

While playing my child(ren) and or myself may be exposed to dangers and hazards, including but not limited to: trip hazards, hostile or aggressive wildlife, snake bites, falls, skin cuts or scrapes, sprains, bone fractures, concussions, plant allergens or other irritants, biting or stinging insects,

If you do not wish to be exposed to such risks associated with play activities provided by Sunny Kids Club under the terms of the Waiver Agreement ("Form") below, you should not participate in play services organised by Sunny Kids Club.

You are advised that play services may include activities such as climbing that may be a Dangerous Recreational Activity with Obvious Risks as defined by the Civil Liability Amendment (Personal Responsibility) Act 2002.

YOU ARE PARTICIPATING AT YOUR OWN RISK.

I UNDERSTAND that participation in activities can expose the named participant to risk and possible injuries. I understand that there is a qualified First Aid attendant on site and hereby consent to receive medical treatment, including transportation to a doctor or hospital, which may be deemed advisable in the event of injury, accident and/or illness during this activity.

I UNDERSTAND that play activities may involve risks that may cause various injuries and that such injuries may result in death or severe disability. 

I UNDERSTAND that play may result in adverse health events such as hyperventilation or injury caused by falls.

I UNDERSTAND the risks of play and wish to participate in play services organised by Sunny Kids Club and do so entirely at my own risk of injury or bodily harm to myself and my child.

I UNDERSRAND that due to the location and nature of our sessions, the weather has the potential to impact participants’ safety. I recognise that Sunny Kids Club reserves the right to cancel/implement alternative activities in the event of inclement and undesirable weather or other unforeseen circumstances.

I AGREE and acknowledge that wearing any jewellery and or loose articles of clothing (including but not limited to ties, scarves, etc.) is a potential risk during outdoor play and climbing and could lead to serious injury and accept this form as formal advice from Sunny Kids Club to remove such items during all play activities.

I AGREE I am not under the influence of alcohol, drugs or any illicit substances.

This Waiver applies to children’s play services provided by Sunny Kids Club, ABN 81 579 145 928.

By signing the Form, I confirm I have read this WAIVER AND UNDERSTAND I ASSUME ALL RISK IN RELATION TO PLAY SERVICES PROVIDED BY SUNNY KIDS CLUB.

I hereby release Sunny Kids Club, all employees, staff and assistants of Sunny Kids Club and Dunsborough Community Farm or any other persons involved in my participation play services from any suit, demand, action or claim for compensation, whether for personal injury or damage to property arising from my participation.

I AGREE, and I am aware that this Waiver is ongoing and will apply to all future occasions participate in play services by Sunny Kids Club.

I furthermore acknowledge that this document is contractual and may be relied upon in any proceedings by me, my heirs, executors, and assigns.
